Terms and Conditions of Sale for Photogear

Welcome to Photogear. By purchasing from us—whether online, via phone, email, TradeMe, or in-person—you agree to the following terms, which may be updated occasionally. We encourage you to review these terms periodically on our website.


Pricing & Product Information

Our prices are listed in New Zealand Dollars (NZD) and are subject to change due to exchange rate fluctuations or supplier pricing adjustments. In the event of a pricing error, we are not obligated to honor the incorrect price. If there is a significant price change after you have placed a backorder, we will either refund you or request the additional amount. We aim to provide accurate product details but are not responsible for any inaccuracies.

Purchasing items on special

Items on special may be clearance items which is subject to stock availability. If you make an order for quantity greater than what we have currently available, we will contact you to confirm if we can supply the remaining quantity at the same price or if we have to refund you for the unfulfilled quantity.



Our prices include Goods and Services Tax (GST) at a rate of 15%.



Products typically come with a manufacturer's warranty of at least 12 months, with certain items having only a 6-month warranty, to protect against manufacturing defects. Within this period, if you return a faulty item, we will send it for assessment and follow the manufacturer's policy on repair or replacement. Our warranty does not cover damage from liquids, impacts, misuse, or unauthorized modifications.


Consumer Guarantees Act Compliance

We adhere to the Consumer Guarantees Act 1993 and other relevant laws. However, if you purchase goods for business purposes, you agree that the Consumer Guarantees Act 1993 will not apply. By purchasing for business use, you agree to indemnify Photogear against any claims under this Act.


Stock Availability

We endeavor to maintain accurate stock information, which is indicated on our product pages. If there is a stock discrepancy after you have made a purchase, we will contact you. Backorders are permitted for out-of-stock items, with the provided ETA being an estimate. If the actual ETA differs, we will inform you and offer a refund if the new ETA is unsatisfactory.



We accept various payment methods and offer finance options through partners. Payment must be complete before shipping unless prior arrangements are made.



Orders paid in full by 2:00 pm are ususally dispatched the same day, except on weekends and public holidays. Inspect your delivery upon arrival and report any discrepancies or damage within 7 days, as we cannot be held responsible afterward.


Returns, Refunds, and Exchanges

If a product is faulty, contact us for an RMA number and return instructions. We will adhere to the warranty policies stated above. An initial inspection fee may apply for some brands, refundable if warranty service is required. For non-faulty products, returns due to change of mind are not guaranteed and are subject to a restocking fee. Returns must be requested within 14 days of purchase and items must be in their original condition.


Privacy Policy

Your privacy is paramount, and we treat your personal information with the utmost confidentiality. We do not retain credit card details and use your personal data primarily to process your order. You may also subscribe to our newsletters and promotions.

The content on our website is owned by us or our suppliers and is not to be used without our consent.
